There is no question that the St. Louis County grand jury decision to not indict Officer Darren Wilson in the death of Michael Brown is one of the most controversial and polarizing events in criminal justice in recent history.  St. Louis County District Attorney Robert McCulloch was criticized for not fulfilling his responsibilities as prosecutor to secure an indictment because he introduced all of the evidence, highlighting the inconsistencies in the evidence, to the detriment of securing an indictment against Officer Wilson.

For this assignment, you will review the National District Attorney’s Association (NDAA) National Prosecution Standards.  In a two to three page paper, answer the following questions:

  • What are the NDAA National Prosecution Standards that district attorneys should follow as it pertains to grand jury prosecutions?
  • Based on those standards, should McCulloch have introduced all evidence, including the evidence highlighting inconsistencies?
  • Were McCulloch’s actions ethical according to Kantian ethics?  Deontology? Utilitarian ethics?”
